AFB Virtual Seminar: New FCA Guidance on Non-Financial Misconduct: An Overview

AFB and Ashurst invite you to attend a virtual seminar that will explore the FCA’s newly proposed guidance on non-financial misconduct (NFM) published in early July 2025. 

The FCA originally consulted on proposals regarding NFM in September 2023. By way of follow up, the FCA has now released a joint Consultation and Policy Statement (CP25/18) which includes a re-consultation on proposed guidance covering NFM.

Why attend?

The FCA’s proposed guidance seeks to provide clarity for banks on how NFM may be relevant in the context of fit and proper assessments and make it easier for banks to interpret and consistently apply the Conduct Rules in the context of NFM.

During this session, Ashurst will give an overview of what the new draft guidance covers, share views on its potential impact (including in the context of existing policies and procedures) and provide details on the expected timeline for implementation.

Speakers

Nathan Willmott, Partner, Regulatory Enforcement

Nathan specialises in representing financial institutions, and individual members of senior management on investigations and other complex regulatory and legal issues. He has over 25 years’ experience of supporting regulated firms and individuals in relation to FCA, PRA and multi-jurisdictional Enforcement investigations and proceedings concerning suspected regulatory breaches, skilled person reviews, SMCR and governance issues, whistleblower investigations, conducting internal investigations and handling related litigation.

Adam Jamieson, Partner, Regulatory Enforcement

Adam specialises in advising banks and senior individuals involved in internal and regulatory investigations.  Adam has significant experience of representing clients in regulatory enforcement investigations conducted by the UK regulators and advising on non-financial misconduct related matters (including from an SM&CR perspective).  Adam previously spent a year on secondment to the FCA’s Enforcement & Market Oversight Division.

Crowley Woodford, Partner, Employment

Crowley specialises in all aspects of contentious and non-contentious employment law with a particular emphasis on discrimination, employee disputes and workforce restructuring.

Crowley has extensive experience in cross-border employment issues, collective labour issues, redundancies and workforce restructuring, ARD/TUPE, corporate transactions, corporate governance matters, executive arrivals and departures, whistleblowing, discrimination claims, protecting confidential information, and enforcing and resisting post-termination restrictive covenants. Crowley is also an expert in leading complex internal investigations including within a regulatory environment.
